Unfaithful Army Commando divorced

A ZAMBIA Army Commando has been divorced in Lusaka’s Chilenje Local Court for marrying his lover secretly.

This is in a matter in which Oscar Chilufya 38, of Ndola was sued by his wife Gertrude Kafula,35, of Mtendere East township for divorce because of his unfaithfulness.

The two got married in 2014 and have two children.

Kafula said the couple had been living well until 2018 when the other woman came into the picture.

The two were appearing before Local Court Magistrate Hildah Choonya sitting with Ackim Phiri and Fransesca Zulu.

 “I once spoke to my husband’s lover in September but they continued seeing each other, we even argued over her and then he stopped paying rentals, buying food and paying for our son’s school fees,

“On February 2 he got married to the same lady and he came to get his belongings without saying anything to me, I only got to know about the marriage through Facebook,” said Kafula

She told the court that all what she wanted was divorce because apart from him marrying his lover, the two had never lived together.

“I want us to divorce because we have never lived together. He stays in Ndola and he only comes here in a while and goes back because of his job as a commando,

“I would ask him to take me with him but he refuses yet his colleagues are living with their wives in Ndola,” she said

In defence Chilufya told the court that he never stayed well in the marriage and quickly agreed to divorce. “We will divorce since that is what she wants,” said Chilufya

 The court observed there was no commitment in their marriage which should be based on trust and love without which nothing would work.

The court ordered Chilufya to compensate Kafula with K7, 000 and also to care of the children which it left in the custody of their mother because they were still young.

 “You will have 100% access to them, Divorce has been granted and the property acquired together will be shared equally” said Magistrate Choonya”.

In another matter Innocent Mupeta of Bauleni compound sued Steven Phiri, 27, student at Cavendish for impregnating his 25 year old daughter.

“I want him to pay me K40, 000 which I have spent on my daughter’s upkeep, we would call him for meetings but he never showed up that’s why I brought him here,” said Mupeta

Magistrate Choonya however reduced the amount to K8, 000.
