Man fined K6, 000 for impregnating pupil

A MAN of Lusaka’s Chilenje Township has been charged K6, 000 for deflowering and impregnating a grade 12 pupil.

Evans Saili, 26, of Chalala was sued by Godfrey Chali, 51, of New Chilenje for impregnating his 22-year old daughter.

Chali told Magistrate Ackim Phiri sitting with Magistrate Hildah Choonya in Chilenje Local Court that Saili was married and could therefore not marry his daughter.

“I just want him to pay for the damages. He damaged her last year when she was in grade 12 and she was unable to sit for her exams. Saili disappeared from Lusaka for two months and when I called him his wife answered that’s how I knew he was married and has a child,”

“I charged him K12,000 and he has not paid anything but if he was not married I would have allowed them to get married. I just want him to compensate me since he is already married,” said Chali

He went on to tell the court that since his daughter had a miscarriage, he was prepared to knock off K2, 000.

In defence Saili told the court that he did not break her virginity but only impregnated her and did not refuse to pay the damages.

“He charged me in the absence of my family, since they are not in Lusaka, I can be making monthly payments of K500,

“I was not the first man to sleep with her. I was the second I just made her pregnant and I told her father that I wanted to marry her and have two wives,” said Saili

The court called Grace Chali to the front and readily admitted that Chali did not break her virginity as he was the second man to sleep with her but only made her pregnant.

“You made a mistake by sleeping with someone’s child without the parent’s permission,” said Magistrate Phiri”.

The court however ordered Saili to pay K6,000 since there was no issue of deflowering the girl which should be paid in monthly installments.
