Judgement day set for man accused of attempted rape of mother to defiled

THE Choma Fast Track Court for Gender Based Violence has set the date for judgement involving a man who was allegedly obsessed with a 16-year-old girl but ended up attempting to rape her mother for protecting the teenager.

In this matter, Nevers Malambo, 25 of Mutandalike area of Chief Choma’s chiefdom is charged with indecent assault on a female contrary to the Laws of Zambia.

Particulars of the offence are that Malambo on May 9, 2020 in Chomaunlawfully and indecently touched a female without her consent.

When the matter came up for continued trial, Senior Resident Magistrate Idah Mupemo found Malambo with a case to answer and placed him on his defense.

This was after Defective Constable Stella Khondowe testified to having thoroughly investigated the matter and visiting the scene of crime before she charged and arrested Malambo with the subject offence.

After she gave her testimony, Magistrate Mupemo found it prudent that Malambo gives his side of the story as the evidence was so overwhelming.

After Malambo gave his unsworn statement in his defence, the court adjourned the matter to July 14, 2020 for judgement and remanded the accused in custody.

Earlier, the 33-year-old female victim testified that Malambo was too obsessed with her daughter with whom he wanted to be in a romantic relationship. 

She said on two occasions she rescued her teenage daughter from the accused who always stalked her when she was out herding goats.

She said, on the fateful day as she was herding goats, Malamboapproached her and inquired about the daughter. When she tried to ignore him and turned her back on him, Malambo tackled her from behind and she fell.

The victim said, Malambo told her that since she was hiding her daughter he would do to her what he wanted to do with her daughter

“He tackled me to the ground from behind and got on top of me, he tried to pull down my leggings but I wrestled him”

“He tore my chitenge, but in the process of wrestling with him a piece of his shirt sleeve ripped off and remained with me” she testified.
