CHOMA COURT ORDERS ‘MENTAL CHECK UP’

THE Choma Fast Track Court for Gender Based Violence has ordered for a mental examination of a 23 years old man who is alleged to have sexually abused a 2 years 7 months old girl through her anus.

In this matter Brian Mudenda a resident of Mutepaile Village in Chief Mapanza’a Chiefdom is charged with un-natural offences contrary to section 155 (a) (i) as amended by Act No.15 of 2005 of Chapter 87 of the Penal Code of the Laws of Zambia.

Allegations are that Mudenda had unlawful carnal knowledge of a girl below the age of 16 an act that was done against the order of nature.

The incident is said to have happened on 27th March 2020 in Chomadistrict of Southern Province.

According to the police statement, the child sustained severe cuts on her anal area and bled profusely after the sexual abuse.

When matter came up for plea before Senior Resident Magistrate IdahMupemo, the accused person failed take plea even after many efforts by the Court to engage him.

The Court then engaged his father who stated that his son is not mentally stable.

Mr Lloyd Mudenda who was under oath said his son could only understand a but cannot speak.

Magistrate Mupemo then stood the matter for a few hours to see if the accused’s condition may change but this proved futile after the matter was recalled for the second time.

The Court thus ordered that the accused person be taken to ChainamaMental Hospital to ascertain his mental faculties.

Mudenda was remanded in custody as he awaits to be taken to mental facility.
