`ASSAULT CASE TO PROCEED WITH OR WITHOUT DEFENCE LAWYER’

A matter involving five family members who allegedly assaulted a man will proceed at the next sitting whether or not the accused persons engage a lawyer, the court has said.

This is in a case were Izukanji Simbule, 24, a student, Cliff  Simbule50 a businessman, Sylvia Simbule 44 a secretary, Mapalo Simbule 19 a student and Wiza Simbule 21, a student allegedly assaulted ChrisantiusChangwereza 34, of Makeni thereby causing him occasioning actual bodily harm on December 24 2019.

The matter came up for mention and setting of defence date.

The lawyer whom the accused person claimed to have engaged was not present and not   known to the court.

The lawyer who was earlier handling their matter was transferred and they were given an opportunity by the court in the precious sitting to engage another lawyer when they made an application last week.

Magistrate   Bwalya said the matter will continue at the next sitting whether or not they engaged a lawyer.

Four of the accused persons are yet to give their defence and Cliff Simbule will call a witness. 

The court adjourned the matter to August 7, 2020 for continue defence.
