A LUSAKA husband has dragged another man to the Lusaka High Court for trespassing and committing adultery with his wife and is demanding K2 million damages.
Gilbert Mbamwabi Lungu has sued Patrick Maswakeni for adultery after he allegedly found him red handed in his matrimonial bed with his wife, Susan Chewe.
Lungu stated in his statement of claim that he has been at all material times a husband to Susan Chewe having been traditionally married under customary law and having paid a dowry at K1,000 in the presence of his cousin, Sydny Lukunyendo.
He stated that he will tell the court at trial that on 30 April, 2020 he found Mr Mwaswakeni at his matrimonial home committing adultery with his wife Chewe.
Lungu stated that he would further aver at trial that on finding the defendant red handed with his wife he confiscated the defendant’s shoes and a mobile phone as exhibits.
He stated that he would further demonstrate at trial that upon being caught, Mwanswakeni, became violent and assaulted him, an act which resulted in him suffering a swollen right arm, painful left side of the neck and painful leg.
Lungu stated that he would show at trial that Mwaswakeni had malicious intention to injure, anger and interfere with his marriage when he trespassed into his wife thereby, causing the plaintiff to suffer severe mental torture and injuries as a result of the defendant’s unreasonable behaviour.
He stated that Mwaswakeni has without any justifiable reason committed adultery with his wife thereby, putting his life at risk as he is not sure about his health status.
