DEFENCE in a matter where five persons allegedly assaulted a man has failed to continue for the second time.
This is in a case where Izukanji Simbule, 24, a student, Cliff Simbule, 50, a businessman, Sylvia Simbule, 44 a secretary, Mapalo Simbule 19, a student and Wiza Simbule 21 a student allegedly assaulted Mr Chrisantius Changwereza, aged 34, of Makeni thereby causing him occasioning actual bodily harm on December 24, 2019.
This was when the matter came up for defence at the Lusaka Magistrates court before magistrate Jennipher Bwalya.
Mr Aggripa Malando, a lawyer from the Legal Aid Board said a colleague who was representing the five defendants was transferred and he has since taken up the matter.
Mr Malando said he will represent the five but was not ready to proceed with defence because he needs to update himself with the case and get instructions from Izukanji and Wiza who were absent.
Mr. Malando informed the court that Izukanji and Wiza were quarantined having been in contact with a relative suspected to have Covid-19.
Mr. Malando applied for the matter to be adjourned.
Public prosecutor Mr. Museta said it was the second time the defence was applying for an adjournment and had no objection to the application.
Magistrate Bwalya warned that it is the second time the defence was applying for an adjournment. She said May 20 was the last time the court heard from the defence.
After entering a plea of not guilty, Magistrate Banda adjourned the matter to August 11 for trial. Kambole is in custody.
