The matter involving a 37 years old woman who left her friend in gory after stoning her for fear of being stabbed, failed to take off in the Choma Magistrates Court.
In this matter Fallacy Mvula of Choma’s Zambia Township is charged with Assault Occasioning Actual Bodily Harm contrary to section 248 of Chapter 87 of the Penal Code of the Laws of Zambia.Allegations are that Mvula assaulted Juliet Mundenda in unclear circumstances thereby occasioning her actual bodily harm.The alleged incident is said to have occurred on August 29, 2020 in Choma District of Southern Province.When she appeared for plea earlier before Magistrate Muyambango Munukayumbwa, the accused person admitted stoning the complainant in self defense.She told the Court that Mundenda charged at her while wielding a knife threatening to stab her, so she used a stone that was nearby to defend herself.But when the matter was called for trial by Senior Public Prosecutor Coillard Sikwalulwa who was ready with three witnesses, Resident Magistrate Ethel Phiri indicated that the Court handling the matter was unavailable.The matter was then adjourned to October 7, for commencement of trial.
Mvula was remanded in custody.
