A ZESCO employee who was dragged to court for allegedly committing adultery with another man’s wife has told the Lusaka High Court that he will make his accuser prove at trial that the woman is his wife.
In this matter Gilbert Mbamwabi Lungu has sued Patrick Maswakeni, an employee of Zesco in Kazungula, for adultery after he allegedly found him red handed in his matrimonial bed with his wife, Susan Chewe whom he married under customary law and having paid K1000 dowry.
Lungu is demanding K2million damages from Mwaswakeni for trespassing and committing adultery with his wife.
But Mwaswakeni in his defence, denied the allegation, stating that he is not aware of the marriage between the plaintiff (Lungu) and Susan Chewe.
He said Lungu will be put to strict proof at trial.
Mwaswakeni stated that he will tell the court that on the material day, he had gone to visit Susan Chewe at her apartment because she is a friend.
He however, denied having been found committing adultery.
Mwaswakeni admitted the fact that his phone and shoes were confiscated by Lungu.
“The plaintiff was the one who started fighting me when he found me in Susan Chewe’s apartment and even damaged the ZESCO motor vehicle which I had parked there and the case for assault was reported at Kazungmgula police station.
“The charge of malicious damage to company property is being heard at Livingston’s Subordinate court,” Mwaswakeni said.
He said Lungu was not entitled to the K2million he claims.
