A 40 years old man has been committed to 60 days community Service for trafficking in over 60 grammes of Marijuana.
This was in a matter in which Botha Halumba was appearing in the Choma Magistrates Court charged with Trafficking in Psychotropic Substances contrary to the Laws of Zambia.Particulars of the offence are that Halumba trafficked in 61.9 grammes of Marijuana a herbal product of Cannabis Sativa without lawful authority.When he appeared for Facts before Resident Magistrate Ethel Phiri, the Court found him guilty in his own admission and convicted him accordingly.According to the facts stated by Public Prosecutor Dexter Kwalela, the suspect was apprehended by Drug Enforcement Commission Officers on September 4, in Shampande Township after they received a tip off that an unknown person was dealing in controlled drugs.Upon identifying the suspect and introducing themselves, the Officers recovered a plastic of suspected Marijuana on Halumba concealed in a plastic.A sample was sent to the University Teaching Hospital to which the results came back positive.Despite vowing never to ever touch Marijuana again, Magistrate Phiri sentenced Halumba to 60 Days community service and in default to serve 3 months simple imprisonment.
Halumba was informed of his right to appeal to the High Court within 14 days if he was not happy with the ruling.
